Employment Practices Liability Insurance (EPLI)

Employment Practices Liability Insurance also known as EPLI provides protection for an employer against claims made by employees, former employees, or potential employees. EPLI covers discrimination (age, sex, race, disability, etc.), wrongful termination of employment, sexual harassment, wage and hour, immigration and other employment-related allegations. It covers your firm, including its Directors and Officers.

Protecting your company and your assets is my first concern, Employment Practices Liability cases are on the increase. With the down turn in the economy many employers have had to make staffing adjustments and these employee actions have sparked a rash of cases.

It doesn’t take a staff lay off to cause an employee action against you and your company. Here are a few of the many areas of concern:

  • Discrimination
  • Harassment
  • Retaliation
  • Termination
  • Constructive discharge
  • Failure to hire, negligent supervision and wrongful demotion
  • Failure to accommodate an employee with a disability
  • Personal injury: infliction of emotional distress and humiliation, defamation and invasion of privacy.

Employment Practices Liability Insurance (EPLI) provides companies and employees coverage for claims made against them that happen as a result of wrongful employment practices.

General Liability Insurance, Workers Compensation and other Insurance do not cover you for EPLI related claims.

The Lilly Ledbetter Fair Pay Restoration Act was signed into law January 9, 2009 that effected these types of policies.
